Felony assault may involve a number of acts intended to cause, or which do cause, serious bodily injury, serious and permanent disfigurement, or grave risk of death, and can also involve bodily injury to police officers and firefighters. The degree of felony assault that is charged is affected by the use or presence of a deadly weapon. Felony assault may be charged in the first or second degree, and ranges from a Class 3 to a Class 4 felony. Convictions for either first degree assault or second degree assault are subject to mandatory enhanced sentencing because they are categorized as violent crimes.
Third degree assault, a misdemeanor, is discussed in a separate section.
